The Sun Herald spoke with a spokesperson for the Biloxi PD who noted that Jack Swagger’s court date for DUI, marijuana possession and speeding is March 12th.
Swagger, 30, of Boca Raton, Fla., was pulled over at 11:59 p.m. on Lorraine Road near Morningside Drive, and arrested on charges of driving under the influence, possession of marijuana and speeding.
An officer stopped him after noticing a 2013 Ford Taurus was speeding, police said.
The spokesperson noted that “He was released on a summons to an acquaintance who picked him up at the police station.”

- ProWrestling.net pointed out that WWE has the legal right to fire Jack Swagger following his arrest last night. Accoring to the Wellness Policy, which you can view here, any talent arrested in possession of drugs is in breach of their WWE contract. The policy states:
Any WWE Talent, who is arrested, convicted or who admits to a violation of law relating to use, possession, purchase, sale or distribution of drugs will be in material breach of his/her contract with WWE and subject to immediate dismissal.
In addition to the penalties that may be imposed pursuant to his/her contract with WWE, a violation of this Section 14 may also be treated as a positive test for drugs prohibited by this Policy and therefore, subject to the penalties set forth in Section 15 of this Policy.

As previously reported, Jack Swagger was arrested on Tuesday night for a DUI and marijuana suspension. The DUI was NOT for alcohol. Per WWE’s Wellness Policy, just being arrested is enough for WWE to release him if they so desired. The policy lists as follows:
“Any WWE Talent, who is arrested, convicted or who admits to a violation of law relating to use, possession, purchase, sale or distribution of drugs will be in material breach of his/her contract with WWE and subject to immediate dismissal.”
In addition, the violation acts identically per the Wellness policy as a positive test for drugs which includes a potential fine, suspension or more. This would be Swagger’s first Wellness violation.
