Actor Robert De Niro has asked a Los Angeles judge to dismiss a claim he falsely filled out an insurance form.

Fireman's Fund Insurance is suing Mr De Niro for $1.8m (£0.91m), the amount it paid to a studio when filming was delayed by his cancer treatment.

The firm said the 63-year-old should have declared he had been tested for prostate cancer just days before signing the insurance forms.

The actor's lawyers said he had no reason to expect positive tests.

The insurance company said: "Mr De Niro failed to fully disclose information which was critical to our decision to offer insurance coverage."

"As a result, the film had to be postponed for four months, at significant cost to the motion picture production company."

Mr De Niro's lawyer, Robyn Crowther, said: "One day you don't have cancer, and the next day you get diagnosed and you do, and this happened to be in the middle of those couple of days."

Mr De Niro, who is attending the Cannes film festival in France this week, revealed his illness just days after his diagnosis in 2003, saying the condition was detected at an early stage and that he was expected to make a full recovery.

The film, Hide and Seek, was released in 2005 by 20th Century Fox and grossed more than $122m (£61.8m) at the global box office.
